Terms of Service

1. Agreement

These Terms of Service (the “Terms”) are an agreement between you and ProdigyAI Solutions SRL, str. Transilvaniei A9, Aiud 515200, Alba, Romania, CUI 47791661 (“we”, “us”). They govern your use of the Tai Chi Service. By creating an account, starting a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase a subscription. If you are younger, you may use the Service only with the involvement and consent of a parent or guardian who accepts these Terms on your behalf.

3. The Service

“Tai Chi”, the “Service”, or the “App” means the Tai Chi mobile applications for iOS and Android, the website at easytaichi.app, the Tai Chi web application, and related services operated by ProdigyAI Solutions SRL. The Service provides Tai Chi instruction, guided practice sessions, personalised practice plans, progress tracking, and related wellness content. Some features require a paid subscription.

4. Accounts

Parts of the Service work without an account, using an identifier tied to your device or browser. You may also provide an email address, or sign in with Apple or Google, so that your subscription and progress can be linked across devices. You are responsible for keeping your sign-in details private and for activity under your account. Tell us at hello@easytaichi.app if you believe your account has been used without your permission.

5. Subscriptions, billing and payment

Subscriptions may be purchased through one of three channels, and the channel you used determines who processes your payment and how you manage the subscription:

• Apple App Store — Apple processes the payment and the subscription is managed through your Apple account.
• Google Play — Google processes the payment and the subscription is managed through Google Play.
• Direct web checkout on easytaichi.app — we process the payment through our payment provider, and you manage the subscription through our cancellation page.

Subscriptions may be offered for different billing periods and at different prices, which can vary by country, currency, applicable taxes, platform, and any promotional, introductory, or other special offer available to you. The applicable price, billing interval, free trial or introductory offer, renewal price, and other material terms are shown to you before you confirm a purchase. Payment information is processed by the applicable payment provider or app store; we generally do not receive or store your full payment card details.

We may also offer one-time purchases that unlock specific content and do not renew. A one-time purchase is not a subscription and is not included in one.

6. Free trials and introductory offers

A subscription may begin with a free trial, a paid introductory period at a reduced price, or immediate paid access. Where a trial or introductory offer applies, its length, its price (if any), and the price that applies afterwards are shown before you confirm. Your subscription arrangement begins when you confirm it — including where it begins with a free trial — and, unless you cancel before the trial or introductory period ends, it continues automatically into the paid subscription disclosed to you at purchase. Trials and introductory offers may be limited to one per person, account, or payment method.

7. Automatic renewal

Subscriptions renew automatically at the end of each billing period, at the renewal price shown at purchase (or a changed price you have been notified of under section 9), until you cancel. By confirming a subscription you authorise the applicable payment provider or app store to charge your chosen payment method at each renewal. Apple and Google apply their own renewal timing rules; for example, Apple may require cancellation at least 24 hours before the end of the current period to prevent the next charge.

8. Cancellation

Cancelling turns off automatic renewal. You normally keep access to the subscription for the rest of the period you have already paid for, and you are not charged again. Please note:

• deleting the App does not cancel a subscription;
• simply ceasing to use the Service does not cancel a subscription;
• the way to cancel depends on where you purchased.

• Purchased on our website: use easytaichi.app/cancel-subscription.
• Purchased through the App Store: manage it in your Apple ID subscription settings. We cannot cancel an App Store subscription on your behalf.
• Purchased through Google Play: manage it in your Google Play subscription settings.

If you hold more than one subscription, each must be cancelled separately.

9. Price changes

We may change subscription prices from time to time, subject to applicable law, required notice, platform rules, and any consent required before the new price takes effect. Where notice or consent is required, the new price will not apply to you until it has been given. If you do not accept a price change, you can cancel before it takes effect.

10. Refunds

Except where required by applicable law, purchases are generally non-refundable. We may nevertheless consider refund requests at our discretion. Who can process a refund depends on where you purchased: Apple handles App Store refunds, Google Play refunds follow Google's process, and we handle refunds for purchases made on our website. Consumers in the EU/EEA, Brazil and certain other places have statutory rights that these Terms do not limit. Our Refund Policy explains the details and how to request a refund.

11. Intellectual property

The Service and its content — including videos, animations, audio, text, graphics, practice plans, and software — are owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own non-commercial purposes in accordance with these Terms. You may not copy, distribute, publicly perform, modify, sell, or reverse engineer any part of the Service except as permitted by law.

12. Acceptable use

You agree to use the Service only for lawful purposes and not to: interfere with or disrupt the Service; access it by any means other than the interfaces we provide; circumvent access controls or payment requirements; scrape or harvest content or data; share your access with others; or use the Service to harm anyone.

13. Health and fitness disclaimer

The Service is provided for general wellness and educational purposes. It is not medical advice, and it is not a substitute for advice from a qualified healthcare professional. Consult a healthcare professional before beginning any exercise programme, especially if you are pregnant, have a medical condition or injury, or have other health concerns. Stop immediately and seek medical help if you feel pain, dizziness, or discomfort. The practice plans we suggest are based on information you give us; they are not a diagnosis. Physical activity carries inherent risks, and you are responsible for deciding whether an exercise is suitable for you.

14. Service availability and changes

We continually improve the Service and may add, change, or remove features and content. We aim to keep the Service available but do not guarantee uninterrupted access; maintenance, updates, and factors outside our control can cause interruptions. We may suspend or terminate access where these Terms are breached or where we are required to by law. You may stop using the Service at any time; see section 8 for how to stop a subscription.

15. Disclaimer of warranties

To the extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits the warranties and remedies you have as a consumer under applicable law.

16. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of your use of or inability to use the Service. To the extent permitted by applicable law, our total liability for claims relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

17. Your consumer rights

If you are a consumer, you have rights under the law of the country where you live that cannot be reduced by a contract. Nothing in these Terms limits those rights. In particular, where you buy a digital service that is not delivered as described or does not work as it should, you may be entitled to remedies such as having the problem fixed, a price reduction, or a refund. Consumers in the EU and EEA also have a 14-day right of withdrawal, as explained in our Refund Policy.

18. Governing law

These Terms are governed by the laws of Romania. If you are a consumer living in another country, you also benefit from the mandatory consumer protection provisions of that country, and you may bring proceedings in the courts of the country where you live. Consumers in the EU may also use the European Commission's online dispute resolution platform.

19. Changes to these Terms

We may update these Terms from time to time. For material changes we will give reasonable notice, for example in the App, by email, or on this page, before they take effect. If you do not agree to a change, you should stop using the Service and cancel any subscription before the change takes effect. The date at the top of this page shows when the Terms were last updated.
